Terms and Conditions of Use

3.1 Limitations of Dietary Content

You expressly acknowledge and agree that:

• Dietary Content generated by hello.food is produced by artificial intelligence systems and automated dietary evaluation engines. These systems have inherent limitations, may be incomplete, and may produce errors.
• Dietary Content is not reviewed by a licensed physician, registered dietician, certified nutritionist, or any other licensed healthcare professional before being delivered to you.
• Dietary Content may not account for your complete and current medical history, medications, clinical conditions, or the specific requirements of any therapeutic diet prescribed to you by a healthcare provider.
• hello.food uses a conservative "when uncertain, avoid" safety philosophy with confidence scoring thresholds for allergen and dietary restriction evaluations. However, menus change, ingredients change, cross-contamination risks vary, and we cannot guarantee 100 percent accuracy.
• Menu data provided through the Services is sourced from restaurants, public sources, and automated extraction systems. We cannot guarantee the completeness, accuracy, or currency of any menu information.

3.2 Your Responsibility to Consult Medical Professionals

Before making any significant dietary changes, following any specific dietary recommendations from the Services, or relying on hello.food Dietary Content in connection with any health condition, allergy, intolerance, or prescribed therapeutic diet, you should consult a qualified healthcare professional, including your physician or a registered dietician.

This is especially important if you:

• Have a diagnosed medical condition that requires a therapeutic diet, including diabetes, celiac disease, phenylketonuria, kidney disease, cardiovascular disease, or eating disorders;
• Have known or suspected food allergies or intolerances that may cause serious or life-threatening reactions, including anaphylaxis;
• Are pregnant, breastfeeding, or planning to become pregnant;
• Are taking prescription medications that may interact with certain foods;
• Are a minor whose dietary needs are being managed under medical supervision; or
• Have been advised by a healthcare professional to follow a specific medical diet.

3.3 Allergen Disclaimer

Warning: If you have a food allergy or intolerance that could cause a serious or life-threatening reaction, you must not rely solely on hello.food to determine the safety of any food or menu item. Always verify allergen information directly with the restaurant before ordering or consuming any food. Restaurant kitchens may change ingredients, preparation methods, or experience cross-contamination at any time. hello.food and FRNTR, LLC disclaim all liability for any adverse reaction resulting from reliance on allergen information provided through the Services.

3.4 Emergency Situations

The Services are not intended for use in emergency situations. If you are experiencing a medical emergency, allergic reaction, or any life-threatening health event, call 911 or your local emergency services immediately. Do not use the Services to seek guidance in a medical emergency.

3.5 No Doctor-Patient Relationship

Use of the Services does not create a physician-patient relationship, dietician-client relationship, or any other professional healthcare relationship between you and FRNTR, LLC, hello.food, or any of our employees, contractors, or affiliated AI service providers.

5.1 Acceptable Use

As a Consumer, you may use the Services to:

• Create and manage your personal dietary profile;
• Discover restaurants and evaluate menu items based on your dietary profile;
• Plan meals, optimize recipes, and receive general dietary suggestions;
• Interact with the Services through voice, text, and image input; and
• Connect to authorized third-party health services for enhanced personalization.

5.2 Prohibited Consumer Use

You may not use the Services to:

• Violate any applicable law or regulation;
• Attempt to access, scrape, or extract data from our systems in an unauthorized manner;
• Reverse engineer, decompile, or disassemble any part of the Services;
• Interfere with or disrupt the integrity or performance of the Services;
• Attempt to gain unauthorized access to our systems or the accounts of other users;
• Use the Services for commercial purposes without our written authorization; or
• Use the Services as a substitute for professional medical advice when you have a known serious medical condition.

5.3 Dietary Profile and On-Device Data

Your dietary profile, or Dietary Graph, is by default stored on your device. If you enable optional cloud sync, your data is transmitted to and stored on our servers in encrypted form. You retain ownership of your dietary data, and we use it only to provide the Services to you as described in our Privacy Policy.

5.4 Third-Party Health Integrations

When you connect hello.food to Apple Health, Oura Ring, Function Health, or other third-party health services, you authorize those services to share data with hello.food in accordance with your permissions. You remain subject to the terms and privacy policies of those third-party services. hello.food is not responsible for the accuracy, availability, or privacy practices of third-party health services.

5.5 Agentic Channel Integrations

hello.food may be accessible through third-party AI platforms including ChatGPT, Google Gemini, Claude by Anthropic, and others. When you use hello.food through these channels, your interactions are also subject to the terms and privacy policies of those platforms. hello.food transmits only privacy-preserving dietary attestations to Agentic Channels. Raw dietary data is never transmitted.

6.1 Owner Eligibility and Representation

To use the Owner Portal, you represent and warrant that:

• You are the owner, operator, or an authorized representative of the restaurant whose menu data you submit;
• You have authority to submit the menu and kitchen data on behalf of the restaurant; and
• The menu data you submit is accurate, current, and does not violate any third-party rights.

6.2 Menu Data License

By submitting Menu Data through the Owner Portal, you grant FRNTR, LLC a non-exclusive, worldwide, royalty-free license to use, store, process, display, distribute, and make available your Menu Data through the hello.food platform and authorized Agentic Channels for the purpose of operating the Services.

This license does not transfer ownership of your Menu Data. You retain full ownership of all Menu Data you submit. We do not sell your proprietary Menu Data to third-party data brokers.

6.3 Accuracy of Menu Data

You are solely responsible for the accuracy, completeness, and currency of the Menu Data you submit. You agree to update your Menu Data promptly when menus, prices, ingredients, or allergen information change.

FRNTR, LLC disclaims all liability for inaccuracies in owner-submitted Menu Data. You expressly agree to indemnify and hold harmless FRNTR, LLC for any claims arising from inaccurate, incomplete, or outdated Menu Data you submit.

6.4 Prohibited Owner Conduct

As an Owner, you may not:

• Submit false, misleading, or fraudulent menu information;
• Submit menus for restaurants you do not own or have authority to represent;
• Use the Owner Portal for any unlawful purpose;
• Attempt to manipulate the deterministic precedence system or interfere with other restaurants' menu data;
• Upload documents containing malware, viruses, or malicious code; and
• Use the Owner Portal in any manner that could damage, disable, or impair the Services.

6.5 Fresno and Central Valley - Free Access Commitment

Consistent with our founding mission, restaurants located within the Fresno metropolitan area and the broader Central Valley region of California will have free access to the hello.food Owner Portal and menu management features indefinitely. This commitment is a core promise of hello.food. Subscription fees may apply to restaurants outside this region. Current pricing is available at hello.food.

6.6 Termination of Owner Access

We reserve the right to suspend or terminate Owner Portal access for violation of these Terms, submission of fraudulent data, or for any conduct we determine to be harmful to the platform, consumers, or other restaurants.

7.1 Our Intellectual Property

The Services and all content, features, functionality, software, and technology comprising them, excluding User-submitted content and third-party components, are the exclusive property of FRNTR, LLC and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, or otherwise exploit any portion of the Services without our express written permission.

7.2 Your Content

You retain ownership of all content you submit to the Services, including dietary profile data and menu data. By submitting content, you grant us the licenses described in these Terms.

7.3 Feedback

If you provide us with feedback, suggestions, or ideas about the Services, we may use such feedback for any purpose without obligation to you. We are not required to keep feedback confidential.

12.1 Nature of AI-Generated Content

hello.food uses large language models and other artificial intelligence systems to provide dietary evaluations, menu analysis, food recognition, and related features. You understand and agree that:

• AI systems can and do produce errors, omissions, and hallucinations;
• AI-generated dietary evaluations reflect the system's best inference based on available data and are not guarantees;
• Our dietary evaluation engine uses a three-level verdict system of generally safer, risky, or avoid with minimum confidence thresholds. A generally safer verdict does not mean a food item is safe for every person or every health condition; and
• Menu extraction and analysis are automated processes that may not capture every menu change, preparation variation, or kitchen circumstance.

12.2 Multi-Provider AI Infrastructure

hello.food uses multiple AI providers, including OpenAI, Anthropic, and Google, with automatic failover. The AI provider serving any given request may vary. All AI providers are subject to their own usage policies and data processing agreements.

12.3 Voice and Camera Features

Voice input is processed to fulfill your request. Camera-based food recognition requires your permission and is used solely for the food identification request you initiate. These features are provided for convenience and informational purposes only.

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.

14.2 Informal Resolution

Before initiating any legal proceeding, you agree to first contact legal@frntr.ai and attempt to resolve any dispute informally for at least 30 days.

14.3 Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services that cannot be resolved informally shall be resolved by binding individual arbitration in Fresno, California, under the rules of the American Arbitration Association (AAA). You waive any right to a jury trial or to participate in a class action lawsuit or class-wide arbitration.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm.

14.4 Class Action Waiver

To the fullest extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action.

15.1 Entire Agreement

These Terms, together with the Privacy Policy and any additional terms incorporated by reference, constitute the entire agreement between you and FRNTR, LLC with respect to the Services.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

15.5 Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent in-app notice at least 14 days before they take effect. Your continued use of the Services after the effective date of modified Terms constitutes your acceptance of those changes.

15.6 Force Majeure

We will not be liable for any failure or delay in performance resulting from causes outside our reasonable control, including natural disasters, pandemics, internet outages, or actions of third parties.
